Terms & Conditions for submission of photos by individuals to Fox Galleries

  1. General

By submitting an image you guarantee that you have read these Terms & Conditions of submitting Photos to Fox Galleries and that you agree to abide by all clauses within these Terms and Conditions.

 

  1. Copyright ownership

By submitting an image to Fox Galleries you guarantee that you are the legal owner of the copyright of that image, or have been awarded full and unrestricted rights from the copyright owner to submit and utilize the image for use by Fox Galleries.

 

  1. Third party rights

By submitting an image you guarantee that such use of the image in the Fox Galleries website does not violate the rights of any other party, does not result in a breach of contract between you and another party and that you accept responsibility for any royalties or fees due to any other party from the use of the uploaded image.

 

  1. Subject matter seen in the photos

By submitting an image you guarantee that any content, products, locations or persons contained within the image which are clearly identifiable, have consented to have their image displayed and sold, or that you have full rights to display and sell the image in this manner and accept full responsibility for such use.

 

  1. Accepting and rejecting images

All images submitted to Fox Galleries will be assessed by the curator of Fox Galleries for suitability. This curator will either reject or accept each image for fitness of use. The decisions of the curator are irrevocable.

 

  1. Responsibility for content

When submitting an image you are solely responsible for their content and for any offence, claims or damages that arise from the content of those images. The approval and submitting of images to the site by a curator of Fox Galleries in no way alters or diminishes your responsibility and does not transfer any responsibility for the content of the image to Fox Galleries or the curator who approves the image for posting.

 

  1. Rights granted to Fox Galleries

By submitting an image to Fox Galleries you thereby grant to Fox Galleries full rights to publically display, copy, reproduce, sell and distribute the image globally in perpetuity.

 

  1. Selling your own art

You are able to continue selling your own works. Fox Galleries is working to achieve certain standards, uniformity and image quality and permanence as a priority. Artists must reproduce their works with the same media and archival inks to maintain the standards of Fox Galleries. Works you sell will need to be in line with our listed price, or you will devalue your own product and brand as well as ours. Fox Galleries will also need to be notified of such sales as it may affect the numbered edition of prints.

 

  1. Changes to images

Fox Galleries reserves the right to crop images or to make adjustments to the brightness, exposure, colours or general appearance of any image that it believes warrants such adjustment for the purpose of better display and printing to ensure the highest quality product.

 

  1. Selected images for promotions

Fox Galleries may select certain images that you upload for promotional activities of Fox Galleries business, including but not limited to: for third party users to download as computer background or screen savers; for use in Fox Galleries own promotional materials either on-line or in printed form. Images used for such promotional activities will generally have both the logo of the Fox Galleries and the name of the photographer displayed with the image to promote both parties.

 

  1. Display of name

Fox Galleries considers photography a serious art form and wishes to help contributing photographers who wish to build their reputations. Fox Galleries will endeavour to make your name visible or available on every marketed image to build familiarity with your work and name.

 

  1. Indemnity from claims

You agree to indemnify and hold Fox Galleries and its subsidiaries, affiliates, officers, employees and representatives free from any claim or demand made by any third party due to or arising out of your submitting to Fox Galleries of any images or from any violation of any other party’s rights caused by the use of or the content within the images you upload.

 

  1. Pricing

Fox Galleries reserves the right to price the images as it deems fit. Prices may be raised or lowered for purposes of promotion, discounts, sales or bundled packages. Fox Galleries would like your trust in making decisions relating to pricing, editioning, categorising and the presentation of your works.

 

  1. Updating these Terms & Conditions

These Terms & Conditions will be updated from-time-to-time and Fox Galleries reserves the right to make changes as it deems necessary without giving notification. You are responsible for keeping yourself updated on any such changes herein that might affect you.
